Odyssey and Panache – Limited Warranty

Odyssey Boats provides the following limited warranty to the original retail owner of our products, if purchased from an authorised dealer and operated under normal, non-commercial use, subject to the remedies, exclusions, and limitations set out in this warranty.

1) Five-Year Limited Structural Hull and Deck Warranty
Odyssey Boats will repair or replace, at its sole discretion, any hull or deck structural defect (as defined below) reported during the period of ownership by the original owner.

For the purpose of this warranty, parts and/or materials will be supplied to the dealer, or the work will be carried out by Odyssey Boats.

Definitions

  1. Hull – the single, fibreglass-moulded shell and integral structure within that shell, including stringers, floorboards, transom, and related structural reinforcements.
A structural hull defect means a substantial defect in materials or workmanship in the boat hull that causes the boat to be unfit for general use as a pleasure craft under normal operating conditions.

  2. Deck – the moulded fibreglass shell and integral fibreglass structural components above the hull flange (gunwale/beading).
A structural deck defect means a substantial defect in fibreglass materials or workmanship in the boat’s deck that causes the boat to be unfit or unsafe for general use as a pleasure craft under normal operating conditions.

2) Limited One-Year Warranty on Components

Odyssey Boats will repair or replace, at its sole discretion, any part or component found to be defective in factory material or workmanship, which is not otherwise covered, limited, or excluded by any provision of Odyssey Boats product warranties.

3) Gelcoat

Crystic Gelcoat is our superior weathering ISO/NPG gelcoat, offering better colour stability than competitive ISO/NPG gelcoats. It has been formulated for ease of use in production and has excellent water resistance, with Lloyd’s approval.

Warranty period: 3 years, subject to the cleaning materials used (no ammonia-based products).

4) Upholstery

Our upholstery is designed to be comfortable and aesthetically pleasing, with technical advantages that enable the fabric to withstand extreme conditions. Marine fabrics feature exceptional UV resistance, stain resistance, resistance to microbial attack by bacteria and fungus, and are fire-retardant.
Claims: Any defect in material or workmanship should be reported within fourteen (14) days of delivery.

5) Trailer

Trailer and Trailer Component Parts: All trailer components are warranted for a period of one (1) year from the sale of the vessel, subject to prescribed service intervals.

6) Exclusions

Except as expressly set out herein, all warranties provided by the manufacturers and distributors of components, equipment, and parts on the boat are hereby assigned to the dealer, to the extent permitted by the component manufacturer. Any assistance by Odyssey Boats and/or its authorised dealer regarding component warranties is voluntary.

This limited warranty does not apply to any boat that has been salvaged, or declared a total loss or constructive total loss, for any reason not covered by this limited warranty.

The following are not covered:

  1. Any transportation from owner to dealership or to the Odyssey Boats factory; any haul-out or other expenses incurred, including water testing and dealer labour.

  2. Any failure or defect caused by accident, abuse, misuse, or improper rigging.

  3. Failure to provide reasonable care and maintenance.

  4. Any boat used for commercial purposes, racing, or overpowered contrary to factory specifications.

  5. Engine, drivetrain, controls, propellers, and batteries (these are covered by the engine/brand manufacturer).

  6. Electronic equipment and sound systems (covered by the equipment manufacturer).

  7. Any form of decking (not covered under warranty by Odyssey Boats).

  8. Towers, including stress cracks (not covered by Odyssey Boats).

7) Modifications

8) Liability & Limitation of Liability – Exclusion

This limited warranty is for the benefit of the purchaser and Odyssey Boats and does not create or evidence any right in any third party. The repair or replacement of any component parts as provided under this warranty is the exclusive remedy of the purchaser. The decision regarding whether a part or component should be repaired or replaced will be made by the applicable Odyssey Boats authorised servicing dealer and/or Odyssey Boats.

To the maximum extent permitted by applicable law, in no event shall Odyssey Boats be liable for any incidental, consequential, special, indirect, punitive, or exemplary damages, or lost profits, arising out of the use or inability to use the boat or any component thereof, or for any breach of this limited warranty or otherwise, even if Odyssey Boats has been advised of the possibility of such damages or such damages could reasonably have been foreseen.

Odyssey Boats’ entire liability under any provision of this limited warranty shall be limited to the repair or replacement of the boat, trailer, or component part, or the refund of the purchase price paid by the consumer for the boat, trailer, or component part found to be defective within the applicable warranty period. This shall constitute Odyssey Boats’ sole liability and obligation in the event of any claim arising out of its performance or non-performance under this limited warranty.

9) Transferable Warranty

The warranty remains in place from the original date of registration for the duration of its term.

10) Owner / Dealer Obligations

It is the responsibility of the owner/dealer to ensure that the warranty registration is completed and lodged with Odyssey Boats within fourteen (14) days of the original date of purchase/delivery. Failure to register a warranty will invalidate any future claims.

All warranty claims must be initiated by the owner/dealer as soon as possible after a fault or defect is detected. Notice of intention to initiate a claim should include a description of the nature of the defect (with photos and a detailed description), together with the boat serial number, date of purchase, and the dealer from whom the boat was purchased.

Odyssey Boats will provide written consent and advice on the remedial action that should be taken. No remedial work is authorised without the written consent of the Odyssey Boats factory.

Any unsatisfactory repair work done by an authorised Odyssey Boats dealer should be brought to the attention of the Odyssey Boats factory at the earliest possible opportunity after such work is carried out. As with any purchase, the owner has a responsibility to take the necessary care and perform regular maintenance to ensure full benefit and enjoyment from the purchase. Please read all safety notices and abide by the rules of the authorities – it will make your boating experience more pleasurable and safer for yourself and others.
